Terms of Service
Welcome to Textology! These Terms of Service ("Terms") govern your access to and use of Textology's call center and VoIP services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.
1. Eligibility
You must be 18 years or older and acting on behalf of a legitimate business.
2. Use of Services
You agree to:
- Provide accurate information.
- Use the Services only for lawful purposes.
- Maintain proper consent for all communications.
- Prevent unauthorized access to the platform.
- Follow all applicable telecom regulations.
3. Telecom Compliance (TCPA, FCC, 10DLC, Call Recording Laws)
By using our Services, you acknowledge and agree:
- You are solely responsible for complying with TCPA, FCC, CAN-SPAM, STIR/SHAKEN, 10DLC, and state call recording laws.
- You must maintain valid consent for all outbound numbers.
- You must register 10DLC brands and campaigns if sending SMS messages.
- You must comply with Caller ID, agent behavior, and dialing laws.
- Violation may lead to suspension or termination.
4. HIPAA & PHI Usage
Textology Inc. is not HIPAA compliant by default.
You may not store or process PHI unless we have signed a Business Associate Agreement (BAA) with you.
5. Prohibited Conduct
You may not:
- Upload purchased or scraped contact lists.
- Send unsolicited calls or messages.
- Harass or deceive recipients.
- Upload harmful or illegal content.
- Use the platform for fraud or abuse.
- Interfere with platform security.
6. Billing & Payments
- Payment terms follow your signed agreement
- Non-payment may result in service suspension
- Fees are non-refundable unless otherwise stated
7. Intellectual Property
All software, UI/UX, branding, and platform components belong to Textology Inc.
8. Disclaimer of Warranties
The Services are provided "as is" without warranties of uninterrupted operation or suitability for specific purposes.
9. Limitation of Liability
To the maximum extent allowed by law:
- Textology Inc. is not liable for indirect damages, lost profits, or data loss
- Total liability is limited to the amount paid in the preceding 12 months
10. Termination
We may suspend or terminate your access for:
- Policy violations
- Regulatory noncompliance
- Fraudulent activity
- Non-payment
You may terminate according to your signed agreement.

These Terms are governed by the laws of New York, USA
